Terms and conditions

Bali Valet Storage provides air conditioned climate controlled self storage units. Rent, related fees, and unit availability may vary by location. There is no insurance coverage provided by BVS for the contents of units. Furthermore units are not designed to stand fire, explosions, intense heat, smoke, water, building collapse, or similar perils. You assume the entire loss of the unit’s content from such risks. We recommend that you arrange to have the contents of your unit insured by your personal insurance carrier. We lease the unit to you subject to our terms and conditions and any rule changes we post on the official website of the company.

Definitions

These terms and conditions the following terms, shall have the following meanings:
“Bali Valet Storage (BVS)” refers to the owner of the storage facility.
“Customer” refers to the person who rents the self storage unit.
“Unit” refers to the self storage unit rented by the customer in the BVS warehouse and identified agreement.
“Warehouse” means the building in which the unit is located and includes the entrance, loading dock, parking lots.
“Rent” refers to the amount of money paid by the customer to the BVS for the rental of the unit.
“Agreement” refers to the agreement between BVS and the customer for the rental of the unit, which is governed by these terms and conditions.

Relationship

The customer:
Customer agrees to rent the unit from BVS for the purpose of storing the customers personal and or business property (the customers property)
The customer has full knowledge of the personal or business property stored in the unit.
The customer warrants that they are the owner of the personal or business property in the unit and are legally entitled to it.
Bali Valet Storage BVS (which term includes its directors, employees and agents)
Agrees to rent the unit to the customer.
Does not and will not be deemed to have knowledge of the customers property stored in the unit.
Is neither a Bailee nor a Warehousemen of the customers property and the customer acknowledges that BVS does not take possession of the customers property.

Rent

Rent shall be paid in advance, and rent shall be due and payable upon signing this contract.
Rent paid online Weather weekly, monthly, quarterly, semi annually, or annually will be established as a subscription and billed the day before the rent period starts.
Rent shall continue to a crew and be payable until the unit is surrendered to BVS.
The customer will be charged a deposit which will be included in the initial payment and be paid by the customer pursuant to clause 3.a
Customer shall pay BVS the daily, weekly, monthly, quarterly, semi annually, or annual amount set forth in agreement and at the time set forth in agreement. If customer fails to pay any fee within 5 days of the due date, customer shall be in default of the terms and conditions of this self storage rental agreement, and BVS shall have the right specified in section 7 below.
Access to the unit will denied any time rent is in arrears or charges are past due.
BVS may increase the storage fees or any other fees or charges payable under the agreement at any time, but not less than six months after the commencement date by giving a customer no less than two weeks written notice.
In the event, customer, or BVS terminates the lease agreement prior to expiration or annual renewal there will be no refund of any rental charges.

Storage Space

Customers property, Shall be stored in the unit specified in this agreement.
Customer understands and agrees that the fees for the unit specified in agreement shall be due whether or not all or only a portion of the unit is used to store customers property.
The amount of the storage space may be increased or decreased at any time during this agreement upon the written consent of both parties.
The unit may only be used for storing certain types of your personal property.

Transportation of property and transportation fees

If a customer requests, BVS will pick up or deliver property to any locations specified by customer. Any such request shall specifically identify by:
Detailed list of all items to be picked up.
Google map location for the pick up or delivery, including any specific instructions regarding pick up or delivery.
Specified date and time for pick up and delivery.
Arrangements must be made promptly in advance of the delivery time in order to permit BVS to comply with the request.
BVS may refuse a request if BVS reasonably believes that it cannot perform the pick up or delivery within the time specified by the customer.
If a customer requests BVS to perform any pick up or delivery, the customer will pay to BVS the fee set for the transportation.

Access and Conditions of Use

Customer:
Has the right to access the unit during BVS business hours seven days per week. After hour access can be arranged with 24 hour notice.
Is solely responsible for securing the unit in a manner, which is acceptable to BVS.
Keeps the unit in “As good as it is now” condition. Ordinary wear and tear excepted. If customs damages the unit, the customer will promptly reimburse BVS for the cost of any repairs necessary to return the unit to its original condition.
Customer must not store, or allow anyone else to store any of the following goods in the unit:
Food or perishable goods.
Bird, fish, animals, or any other living creature.
Combustible or flammable materials or liquids, such as gas, oil based paint, petrol, oil, or solvents.
Firearms, explosives, weapons, or ammunition.
Chemicals, radioactive material, or biological agents.
Toxic waste, asbestos or other materials of potential hazardous nature, or that are environmentally harmful.
Any item which emits any fumes smell or odor.
Any illegal substances, illegal items or goods illegal obtained, including counterfeit goods.
Compressed gasses
Customer must not:
Obstruct the entrance to any other storage space.
Create any nuisance to BVS or any customers of BVS.
Attach anything to the internal or external surface of the unit or make any alterations to the unit.
Allow any liquid, substance, or smell to escape from the unit or any noise to be audible outside the unit.
Leave any waste that is created by storing the goods. The customer will be charged the reasonable cost of disposing of such waste.
Tampering with the electricity in any way, and will ensure that no electrical equipment remains operational in the unit.
Customer will:
use the unit solely for the purpose of storage and must not use the unit as offices or living accommodations or as a home address or carry on any business or other activity in the unit other than storage.
Customer must maintain the unit by ensuring it is clean and in state of good repair.
Customer ensures the goods are dry, clean and free from vermin and food scraps when placed in the unit.
Customer must immediately notify BVS in writing of any change of address physical or email and or phone number of the customer or they alternate contact person.
Grants the entitlement to discuss any default by the customer with the alternate contact person.
Reserves the right to relocate the customer to another unit for the proper management of the self storage facility.

Default

If the customer fails to pay any monies owed to BVS for a period of more than five days or fails to comply with any obligation under this terms and conditions for self storage rental agreement. Time being of the essence, the customer shall be deemed to have committed an act of default.
In the event of default by the customer, BVS may, without prejudice to any other rights, remedies or powers of BVS, exercise, one or more of the following rights, whether or not a formal demand for payment has been made:
Charge a late payment fee.
Deny the customer access to the unit.
Terminate this agreement pursuant to clause 9.a.
Re-enter the unit.
Remove the customers property from the unit and sell the customers property by private arrangement or public auction to collect unpaid monies and/or at the election of BVS, take position of and retain the customers property to satisfy any obligation of the customers under this agreement.
Dispose of the customers property and any other manner, whether for value or not as BVS sees fit.
Customer shall not be entitled to any refund or compensation for the loss of their belongings after Termination of this agreement.

Risk and responsibility

BVS will not be liable to you or any third-party for incidental or consequential damages.
The customers' property is stored at the customers sole risk and responsibility in all aspects. The customer could insure the property for their full replacement value against all risk. Including without limitation to, theft, damage, deterioration, flood, fire, leakage, heat, seepage of any substance from another self storage space, pests, vermin, mildew or mold.
If the customer fails to insure the property in accordance with this clause, the customer will keep BVS indemnified against all claims for any loss or damage to the customers property and from all claims for loss damage or injury that may result from the customers use of the self storage space.
The customer acknowledges that BVS does not ensure the customers property nor accepts any risk or responsibility in respect of the customers property.
The only person who can make deliveries and removal from the unit is the customer and person allowed access as identified on the front page of this agreement unless the customer gives instructions to BVS.
Unless specifically covered by insurance in accordance with clause 8.c, the customer should not store goods which are irreplaceable such as currency jewelry, furs, deeds, paintings, work of art, and items of personal sentimental value.

Compliance with the law

The customer acknowledges and agrees to comply with all relevant laws applicable to the use of the unit. This includes laws related to the materials that are stored, and the manner in which it is stored. Liability for all breach of such laws rests solely with the customer and includes all costs resulting from such breach.

Termination

Either party may terminate disagreement by giving the other party, not less than 14 days notice in accordance with clause 11.a or in the event of BVS not being able to contact a customer, by giving notice to the alternate contact person noted on agreement.
In the event of a breach of any of the provisions contained in section 6, or nonpayment of rent or fees, BVS may terminate this agreement immediately.
Upon termination, the customer must remove all goods in the unit and leave the unit and clean condition and in a good state of repair to the satisfaction of BVS on the date specified.
The customer must pay any outstanding monies and any expenses on default or other monies owed to BVS up to the date of termination or clause 7.b will apply.
Calculations of the outstanding monies will be made by BVS and such calculations will be final.
BVS will send written notice to the customer within seven days of termination of this agreement.

The party shall be deemed to have received, noticed from the other if any of the following have been sent.

Email address recorded on the front page of this agreement.

Assignment

The customer may not assign the customers rights or obligations under the agreement.

Whole contract, waiver

This agreement represents the entire terms of contract between the parties and supersedes, all prior oral and written representations, agreements, or understandings. No statements or representations of BVS or any employee or agent of BVS other than the express recorded in this agreement shall form part of this agreement or create any obligation for BVS.
Any variation or addition to this agreement must be in writing.
Agreement which have the effect of entitling BVS to reimbursement, waving, or limiting our liability and authorizing us to remove and dispose of the contents of the unit will survive the termination of this agreement.
Least of the unit constitutes acceptance of the agreement and any related fee schedules.
